    Dear Members

    We have just received a  letter from the Ministry of Home Affairs dated 29 February 2012. 
   "Based on the decision of the appeal against the deregistration of MMA dated 25 November   
    2011, please be  informed that the Malaysian Medical Association should  hold  the MMA AGM
    for  2012/2013  which  will  be conducted  by the  current  Executive Committee  members  
   elected  at   the  51st MMA  Annual General  Meeting  2011/2012  according  to  the  MMA 
   constitution  and  the  Societies Act 1966 within 6 months as directed by the Minister of Home
   Affairs".

 NEW ANNOUNCEMENT

DECISION OF MINISTER OF HOME AFFAIRS REGARDING THE APPEAL OF THE MMA AGAINST THE DEREGISTRATION NOTICE FROM THE REGISTRAR OF SOCIETIES DATED 15TH NOVEMBER 2011     
    
Pursuant to the ROS decision to de-register the MMA, the President of MMA 
appealed to the Minister of Home Affairs on November 22nd 2011. Under Section 18 of the Societies Act 1966 the Minister has the power to confirm, reject or vary the decision of the ROS. In our case, he chose to vary the decision. The MMA received this information on 25th November 2011 and  a  copy  of  the  letter from the Ministry of Home Affairs is attached here.

This decision means that the MMA can resume functioning normally until our next AGM in  May 2012, when  we  will  hold  the  next  election of  office  bearers,  in  full  compliance with the requirements of the Constitution of the MMA.

The article appearing in the Star newspaper on 1st December 2011 stating "The Malaysian Medical Association (MMA), which was deregistered by the Registar of Societies (ROS) on Nov 16, has been given six months to put its house in order if it wants the decision overturned." and  quoting Deputy Home Minister Datuk Lee Chee Leong that "the MMA should follow stipulated procedures in its own laws and the Societies Act if it wanted to be re-activated." is incorrect as the decision of the Home Minister to "tangguhkan selama 6 bulan" the decision of the ROS means that the MMA is no longer de-registered, from the date of the letter i.e. 25th November 2011.

The letter does stipulate that the MMA will be de-registered if we do not comply with the provisions in our constitution over this 6 month period. However, there is nothing in the letter from the Ministry of Home Affairs which states that a re-election must be held.

Therefore, from November 25th 2011, all MMA activities resumed and the MMA will continue to function fully from now on as the de-registration is not in effect now.

            LATEST ANNOUNCEMENT

The MMA is happy to announce that we have received written clarification (attached here) from the Registrar of Societies regarding the interpretation of the decision of the Minister of Home Affairs in response to MMA's appeal against the cancellation of MMA's registration on 15th November 2011.

The ROS has confirmed that the current Council and Executive Committee will continue to function until the Annual General Meeting, scheduled to be held in May 2012, when another election will be carried out, in full compliance with the provisions under the MMA constitution and the Societies Act 1966.
